Course Description: This course provides a brief historic overview of insurance regulation and discusses the role of the National Association of Insurance Commissioners (NAIC) in drafting model laws and regulations that protect the insurance consumer. It then examines

  1. The rules govern insurance transactions during the marketing process - including the licensing of insurers and agents; the standardization and regulatory oversight of insurance contracts; Fair Credit Reporting and Gramm-Leach-Bliley consumer information privacy requirements; disclosure of information to the consumer; and telephone solicitations and sales presentations.
  2. The prohibitions against unfair competition, including misrepresentations, false advertising and discrimination.
  3. Special rules for variable contracts, including suitability and National Association of Securities Dealers (NASD) rules on Fair Dealing with Customers.
  4. Protections against Unfair Claims Practices – including claims procedures, insurer duties to insureds, and the role of adjusters.
  5. Dispute resolution – including recourse to state insurance departments, theories of recovery in legal actions, settlements, and alternative dispute resolution.

The course is intended to guide insurance professionals, financial services industry professionals, and others who are engaged in the business of insurance and financial services toward an awareness and appreciation of the role which consumer protection plays. Upon completion of this course, they should have a better understanding of: the basis for consumer protection regulation; the roles the agents play in presenting insurance to prospective clients and the rules they must follow; and the process through which insurance claims are resolved and disputes between the insurer and insured are resolved.
